Bankers' Books Evidence Act, 2026 comes into force on 1 October 2026
The Bankers' Books Evidence Act, 2026 came into force on 1 October 2026. The Ministry of Finance announced the date on 11 September 2026; the Gazette notification appointing it is dated 10 September 2026. The Act replaces the Bankers' Books Evidence Act, 1891 and modernises how banking records are used as evidence in legal proceedings.
What the new Act does
- Technology-neutral. It recognises banking records kept in physical, electronic, digital, virtual, cloud-based and other contemporary forms.
- Simpler certification. Records can be certified in a simplified, standardised way, including by manual, digital or electronic signature.
- Summoning bank officials. Where the bank is not a party to the case, the court must record a "special cause" in writing before it summons bank officials.
- Wider reach. The Central Government may extend the provisions to specified financial sector entities or classes of entities.
