Constitutional bodies are institutions created directly by the Constitution, so they have their own Articles, appointment rules and protections. For a TNPSC aspirant this chapter has a bonus: the Tamil Nadu Public Service Commission, the body that conducts your exam, is one of them. The five questions below test the Articles and appointing authorities that appear most often in the Indian Polity unit. The full subject guide is TNPSC Indian Polity.

What this topic covers

  • Election Commission (Article 324): superintendence, direction and control of elections.
  • Union and State Public Service Commissions (Articles 315 to 323): recruitment bodies, including TNPSC.
  • Finance Commission (Article 280): sharing of tax revenue between the Union and the states.
  • Comptroller and Auditor General (Articles 148 to 151): audit of government accounts.
  • Others: Attorney General (Article 76), Advocate General of a state (Article 165), and the commissions for SC/ST.

Answers and explanations

  1. D. Article 324 vests the superintendence, direction and control of elections in the Election Commission. Article 148 is the CAG, Article 280 the Finance Commission and Article 315 the Public Service Commissions.
  2. B. The Governor appoints the Chairman and members of a State Public Service Commission, but only the President can remove them, and for misbehaviour only after an inquiry by the Supreme Court. The Chief Minister has no role.
  3. C. The Finance Commission is constituted every five years, or earlier if the President considers it necessary. It recommends how tax proceeds are shared between the Union and the states.
  4. A. The Chief Election Commissioner has the same security of tenure as a Supreme Court judge, which protects the office from political pressure.
  5. B. Under Article 151, the CAG submits Union audit reports to the President, who has them laid before Parliament. State audit reports go to the Governor.

How to prepare constitutional bodies

The best way to hold this chapter is a four-column table: the body, the Article, the appointing authority, and the removal process. Two rules cover most questions. First, if a body is created for the Union, the President appoints; if it is created for a state, the Governor usually appoints. Second, the removal procedure for independent bodies is deliberately harder than appointment, and that is why the Supreme Court judge comparison appears so often.

Add a Tamil Nadu line to each. The TNPSC conducts the Group 1, 2, 2A and 4 exams, and it publishes its notifications on tnpsc.gov.in. The State Election Commission runs local body elections and the Madras High Court sits above the state judiciary. A question can start with a Tamil Nadu body and end in a general constitutional rule.

Pair this chapter with TNPSC judiciary practice and TNPSC Parliament and Union Executive practice, because appointment questions often cut across all three.
